Welcome to LettuceBuild. These Terms of Service govern your use of our educational platform. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using LettuceBuild, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Educational Purpose

LettuceBuild is designed for educational purposes, teaching game development skills through Roblox Studio. Our platform includes:

  • Interactive coding and game development lessons
  • Progress tracking and achievement systems
  • Teacher and student collaboration tools

3. User Accounts

Account creation and management follows these guidelines:

  • Teachers and schools create student accounts on behalf of students
  • Users must provide accurate information during registration
  • Users are responsible for maintaining the security of their account credentials

4. Teacher/School Responsibilities

Teachers and schools using LettuceBuild agree to:

  • Obtain necessary parental consent or school authorization before creating student accounts
  • Use the platform solely for educational purposes
  • Supervise student usage appropriately
  • Comply with applicable laws including COPPA and FERPA

5. Acceptable Use

Users agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the platform
  • Share account credentials with unauthorized individuals
  • Upload or share inappropriate content

6. Intellectual Property

All content, features, and functionality on LettuceBuild are owned by us and are protected by copyright, trademark, and other intellectual property laws. Users may not reproduce, distribute, or create derivative works without our express permission.

7. Third-Party Services

Our platform integrates with Roblox Studio, which is a separate service governed by its own terms. Users must also comply with Roblox's terms of service when using their platform.

SECTION B: MEDICAL LIABILITY & HEALTH WAIVER (In-Person Activities)

This section applies only to in-person classes, meetings, workshops, camps, and events operated by LettuceBuild, Inc. It does not apply to online-only participation.

8. Nature of In-Person Activities

LettuceBuild programs may include in-person workshops, coding camps, after-school sessions, and other physical or hybrid activities in addition to online learning. By enrolling your child (or yourself, if an adult participant) in any in-person class, meeting, or event, you acknowledge that participation involves inherent risks.

9. Health Representations

By enrolling your child (or yourself, if an adult) in any in-person LettuceBuild activity, you represent and warrant that:

  • The participant is in good physical and mental health and has no known condition that would prevent safe participation
  • You have disclosed to us any medical conditions, allergies, or disabilities that could require accommodation or affect participation
  • You have consulted a qualified medical professional if there is any doubt about the participant's fitness to participate
  • LettuceBuild is not a medical provider and does not provide medical assessments, treatment, or advice.

10. Medical Emergency Authorization

In the event of a medical emergency during an in-person class, meeting, or event, you authorize LettuceBuild staff to:

  • Call emergency services (911 or local equivalent) immediately
  • Administer basic first aid to the extent staff are trained to do so
  • Authorize emergency medical treatment on your behalf if you cannot be reached in time

You agree to provide accurate emergency contact information at the time of registration. LettuceBuild will make reasonable efforts to contact you before authorizing non-emergency treatment, but you acknowledge this may not always be possible in urgent situations.

11. Medical Liability Waiver & Release

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE LettuceBuild, Inc., its officers, directors, employees, volunteers, instructors, and agents (collectively, “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, illness, loss, or damage to person or property that may result from participation in any in-person LettuceBuild class, meeting, or event, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

This waiver does not apply to claims arising from gross negligence, willful misconduct, or fraud by the Released Parties.

12. Assumption of Risk

You acknowledge that participation in in-person coding camps, classes, meetings, and educational events carries inherent risks including but not limited to minor physical injury, allergic reactions, and health episodes. You voluntarily assume all such risks on behalf of yourself and/or your child.

SECTION C: MEDIA EXPOSURE & LIKENESS CONSENT

13. Photography & Video Recording

LettuceBuild and its authorized partners may photograph, film, or record participants during programs, events, camps, and activities (“Recordings”) for educational, promotional, and documentation purposes.

14. Media Consent & License

By enrolling and unless you opt out in writing prior to the activity (see below), you grant LettuceBuild, Inc. a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, publish, distribute, and display Recordings that may include your child's (or your own) image, voice, or likeness for the following purposes:

  • Internal educational documentation and program improvement
  • Social media posts on LettuceBuild's official channels (Instagram, Facebook, YouTube, etc.)
  • Marketing and promotional materials, including website content, flyers, and presentations
  • Grant applications, impact reports, and investor or partner communications

We will not use a child's full name alongside their image in any public-facing material without explicit additional consent.

14A. Opting Out of Media Consent

Media consent is opt-out. If you do not wish for your child to be photographed or filmed, you must notify us in writing by email to yoonjung@lettuce.build before the first session of participation. We will make reasonable efforts to exclude opted-out participants from Recordings; however, we cannot guarantee exclusion from all group photographs or incidental footage.

Opting out of media consent does not affect your child's ability to participate in any program.

15. Recordings Created by Participants

Participants may create game content, videos, screenshots, or other digital media as part of the educational curriculum. By enrolling, you grant LettuceBuild a limited license to display and share such participant-created content for educational and promotional purposes. LettuceBuild will not sell participant-created content.

SECTION D: GENERAL PROVISIONS

16. Disclaimer

LettuceBuild is provided “as is” without warranties of any kind. We do not guarantee that the platform will be error-free or uninterrupted. We are not responsible for any learning outcomes or results.

17. Changes to Terms

We reserve the right to update these Terms at any time. We will notify registered users via email at least 14 days before material changes take effect. Continued participation after the effective date constitutes acceptance of the updated Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. For international participants (including those in Panama and other countries), we comply with locally applicable child protection and data privacy laws to the extent required.

19. Dispute Resolution

Any disputes arising from these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
